BTCPERP Goes Live Onshore in US Derivatives Markets

Key Takeaways05
01

On May 29, 2026, the CFTC issued an Order for Approval to KalshiEX LLC under Commission Regulation 40.3 for the BTCPERP contract, a cash-settled Bitcoin perpetual futures product with no expiration date. Kalshi launched the product for live trading on June 3. This is the first US-regulated Bitcoin perpetual futures contract. The CFTC simultaneously issued guidance allowing Coinbase Financial Markets to route US retail clients to Coinbase International, its Bermuda-licensed subsidiary, for access to global crypto perpetuals and options markets

02

Bitcoin perpetual futures are derivative contracts that track the Bitcoin spot price through a funding rate mechanism rather than expiration-based settlement. When the contract trades above spot, long holders pay short holders; when below spot, shorts pay longs. The mechanism keeps contract price close to spot without requiring delivery or expiration. Perpetuals have dominated global crypto derivatives volume since BitMEX popularized them around 2016, with estimated annual volume above $90 trillion on offshore venues such as Binance, Bybit, and OKX

03

Traditional exchange operators fell on the BTCPERP approval news. CBOE, CME, ICE, and NASDAQ all declined, reflecting investor concern that Kalshi disrupts incumbents whose crypto derivatives revenues came from quarterly-expiry Bitcoin futures products. Kalshi has filed for CFTC approval on perpetual contracts for 12 additional crypto assets including ETH, SOL, XRP, DOGE, and XLM. Polymarket launched its own perpetual product in response, initially invitation-only

04

The Coinbase Bermuda routing guidance is the second structural change in the CFTC's June 3 package. Coinbase Financial Markets, a registered CFTC entity, can now direct US retail clients to Coinbase International for access to global crypto perpetuals and options products not yet approved on a domestic US venue. This creates a regulated compliance bridge to the offshore derivatives market rather than leaving US clients to use unregistered offshore venues directly

05

Perpetual futures are not the same as Bitcoin. A perpetual position at Kalshi is a derivative contract that tracks Bitcoin's price: the holder does not receive Bitcoin, does not control private keys, and depends on Kalshi's solvency, CFTC oversight, and the funding rate mechanism to accurately track spot. The regulated layer solves one problem (legal compliance for US users) while preserving the structural properties common to all derivatives: no key control, no direct custody, and exposure to the counterparty's operational integrity

What Happened

On May 29, 2026, the Commodity Futures Trading Commission issued an Order for Approval to KalshiEX LLC under Commission Regulation 40.3. The order approved the BTCPERP contract, a cash-settled Bitcoin perpetual futures product with no expiration date, for listing and clearing on Kalshi's Designated Contract Market.

Kalshi launched the product for live trading on June 3. BTCPERP trades 24 hours a day, 365 days a year, with cash settlement at the BTC spot reference price. A funding rate mechanism keeps the contract price close to spot by periodically transferring payments from the side of the trade whose position benefits from deviation: if the contract trades above spot, long holders pay short holders; if below spot, shorts pay longs.

The CFTC simultaneously issued guidance allowing Coinbase Financial Markets, a CFTC-registered entity, to route US retail clients to Coinbase International, its Bermuda-licensed subsidiary, for access to global crypto perpetuals and options products not yet approved on a domestic US venue.

The approval is the first time the CFTC has authorized a domestic US venue to list a Bitcoin perpetual futures contract. Bitcoin futures with fixed expiration dates have been available on CME and CBOE since 2017. A perpetual is structurally different: no roll risk, no delivery pressure from expiration, and continuous price tracking that replicates holding Bitcoin in a margin-friendly format.

Globally, perpetuals have been the dominant crypto derivatives product since BitMEX popularized them around 2016. Annual volume on global offshore perpetual venues exceeds an estimated $90 trillion. Until May 29, 2026, none of that volume was available to US retail investors through a domestically regulated venue.

The first US-regulated Bitcoin perpetual futures launched without changing what Bitcoin is. Every new way to hold synthetic exposure is another way to not hold Bitcoin.

What This Changes for Market Structure

Traditional exchange operators saw the announcement as a competitive threat. CBOE, CME, ICE, and NASDAQ all fell on the news. TD Cowen and RBC analysts attributed the moves to concern about Kalshi entering a regulated derivatives space the incumbents had been building out incrementally with quarterly-expiry Bitcoin futures products.

Kalshi's launch, combined with its CFTC filing for perpetual contracts on 12 additional crypto assets (ETH, SOL, XRP, DOGE, XLM, SHIB, HBAR, and others), signals a new competitive dynamic in domestic crypto derivatives. Polymarket announced its own perpetual product in response, initially limited to invited users, a fast follower that does not yet have the same CFTC authorization Kalshi obtained.

The Coinbase Bermuda routing guidance adds a second structural dimension. Rather than requiring US clients to use unregistered offshore venues directly, the CFTC's guidance creates a documented compliance bridge. US clients of Coinbase Financial Markets can now access global perpetuals through a regulated path.

The guidance effectively licenses a portion of the $90 trillion offshore market for US clients by routing it through a CFTC-supervised domestic entity. The distinction matters: using Binance directly exposes US investors to unregistered counterparty risk with no regulatory recourse.

Using Coinbase International through a registered domestic intermediary gives those same investors documented compliance protection, customer fund reporting, and a dispute channel.

◐

The Regulatory Perimeter Is Moving Onshore

The Kalshi approval and Coinbase guidance together reflect the same logic driving Project Crypto, the SEC's April 2026 initiative that reclassified most digital assets as non-securities and authorized tokenized securities on-chain. The US regulatory apparatus is choosing to capture activity that has been offshore rather than prohibit it.

A US retail investor who wanted Bitcoin perpetual exposure previously had three options: use an unregistered offshore venue (Binance, Bybit, OKX), use a registered CME/CBOE quarterly futures product with roll complexity and expiration pressure, or skip derivatives entirely. The Kalshi BTCPERP adds a fourth option: a regulated domestic perpetual on a CFTC-approved DCM.

Offshore perpetuals have exposed US investors to unregistered counterparty risk for years, and bringing the product category onshore with customer fund segregation, CFTC oversight, and dispute mechanisms is a genuine investor-protection improvement over the status quo.

The competitive disruption to traditional exchanges is secondary to the structural implication: the domestic regulated infrastructure for the full crypto financial product stack is approaching completion. Spot ETFs arrived in 2024. Quarterly futures have been available since 2017.

Perpetual futures launched in June 2026. Tokenized securities are authorized under Project Crypto. Each layer adds a new way for a US investor to get Bitcoin exposure without holding Bitcoin. The maturation of that infrastructure is the context in which the self-custody question becomes either more or less important depending on what each investor actually wants from the asset.

What This Means for You

If you self-custody Bitcoin in your own keys, the Kalshi BTCPERP launch leaves your holdings untouched. Your UTXO set is not a derivative. Your private keys give you direct claim on a scarce asset without intermediation. Nothing about the perpetual futures market changes what Bitcoin is or what holding it directly through your own gives you.

The launch does change the market context: as regulated domestic synthetic exposure matures, the composition of Bitcoin market participants shifts toward users holding derivatives rather than direct Bitcoin. That changes price dynamics, but not the underlying asset's properties.

If you are considering Bitcoin exposure for the first time, BTCPERP is now a legal, regulated US option for price exposure without direct custody. The trade-offs are familiar from any derivatives product: you do not hold Bitcoin, you do not control private keys, and your position depends on Kalshi's solvency, CFTC oversight, and accurate spot tracking through the funding rate.

The regulated venue reduces legal risk, not operational or solvency risk. The question is what you actually want: price exposure, or Bitcoin.

The distinction is not hypothetical. Strategy stock holders found in May 2026 that their Bitcoin exposure came with a capital structure obligation: the company sold 32 BTC, its first Bitcoin sale in four years, specifically to fund STRC preferred stock dividend distributions. The mechanism triggering the sale was entirely within the vehicle's capital structure, not any decision by the holders.

Every vehicle that delivers Bitcoin exposure also determines the conditions under which that exposure can be interrupted. Self-custody of native BTC on the Bitcoin network is the only arrangement where the holder's conditions govern the asset rather than the vehicle's conditions.

The Kalshi launch makes that distinction more visible by adding a new option on the non-self-custody side of the spectrum.

What to Watch

Watch Kalshi's CFTC approval timeline for its 12 additional altcoin perpetual filings. If ETH, SOL, and XRP perpetuals receive similar approval, the domestic regulated crypto derivatives landscape expands significantly before 2026 ends. Whether CME and CBOE file their own perpetual contract applications is worth tracking, since incumbents with established clearing infrastructure are well-positioned to compete once the product category is formally authorized.

Polymarket's perpetual product may draw a regulatory response, since Polymarket is a prediction market rather than a CFTC-registered DCM and launched without the same approval Kalshi obtained. Coinbase's implementation of the Bermuda routing guidance shows how quickly global perpetuals become accessible to US retail clients through a compliant channel.

And watch whether the CFTC issues analogous guidance for other registered domestic intermediaries seeking to route US clients to offshore crypto derivatives, since the Coinbase guidance could function as a template that expands US retail access to the full global perpetuals market through regulated channels.
